Cancellation Policy

Right to cancel

Purchasers may cancel their contract in writing (e.g. letter, fax, e-mail) within 14 days, without the need to give a reason or, where the item has been delivered before the end of the 14-day cooling-off period, by returning the item. The period begins upon receipt of a written copy of this policy, but at all events not before the receipt of the item concerned (in the case of multiple or repeat deliveries, not before the receipt of the first partial consignment) and also not before we have met our obligations to provide the relevant information as required by Article 246 § 2 in conjunction with § 1 Sections 1 and 2 of the Introductory Act of the Federal German Civil Code (EGBGB) as well as our obligations under § 312g Section 1 Sub-section 1 of the Federal German Civil Code (BGB) in conjunction with Article 246 § 3  of the EGBGB. The provisions of the cooling-off period will be deemed to have been complied with, providing that the notification of cancellation or the item itself is dispatched within the said period. Consequences of cancellation

Where an order has been cancelled in the appropriate manner, then both parties must restore any items, services or benefits already enjoyed (e.g. interest). If the purchaser cannot restore services and / or benefits already enjoyed, (e.g. benefits of use) or can only partially restore them, or restore them only in a deteriorated condition then the purchaser must restore the proportionate cost of the shortfall. In the case of deterioration or benefits already enjoyed, the purchaser need only restore the residual value to the extent that the use or benefit enjoyed is responsible for the loss of the residual value, such as emerges from an examination of the item's qualities and functions. By "examination of qualities and functions" is meant tests and trials performed on the individual item, such as may be considered possible and/or normal to conduct in the context of a retail environment. Items that can be sent in parcel form are to be returned at our risk. Purchasers must bear the normal transport / postage charges of returning items, unless the item(s) does not correspond to what was ordered, or the cost of returning the item(s) exceeds € 40 or unless, in the case of higher costs, the purchaser has, at the time of cancellation, not yet paid for the items or made a partial payment that has been previously contractually agreed. In all other cases, the purchaser will not be required to pay for the return postage/ transport. Items that cannot be sent by parcel will be collected. Any monies due must be paid within 30 days. For the purchaser, this period begins when he or she sends the notice of cancellation or the item itself; for us it begins with the receipt of the notice or returned item.
